From April 10, a new salary policy for state-owned enterprises will be applied

Decree 21/2024/ND-CP amending and supplementing a number of articles of Decree No. 51/2016/ND-CP dated June 13, 2016 regulating labor management, wages and bonuses for with employees working in single-member limited liability companies with 100% charter capital held by the State and Decree No. 52/2016/ND-CP dated June 13, 2016 regulating salaries and remunerations , bonuses for managers of single-member limited liability companies with 100% charter capital held by the State.

Article 1 of Decree 21/2024/ND-CP amending Article 4 of Decree No. 51/2016/ND-CP detailing salary scales, salary tables, salary allowances.

Accordingly, enterprises rely on production organizations and labor organizations to build and issue salary scales, salary tables, and salary allowances as a basis for arranging salaries, paying salaries, and implementing regimes for employees according to regulations of labor law.

The salary levels in the salary scale, salary table, salary allowances are decided by the company, but must ensure that the salary fund calculated according to the salary levels in the salary scale, salary table, salary allowances must not exceed The planned salary fund of employees according to the provisions of this Decree.

When building or amending and supplementing the salary scale, salary table, salary allowances, the company must consult with the representative organization of employees. Organize dialogue at the workplace according to regulations, report to the owner’s representative agency for comments and publicize it at the company before implementation.

Decree 21/2024/ND- The Government also stipulates in more detail the objective factors affecting labor productivity, planned profits compared to the previous year’s performance that businesses can exclude when determining the planned salary fund.

Article 2 of Decree 21/2024/ND-CP amending Article 3 of Decree No. 52/2016/ND-CP provides more detailed regulations on salary arrangements for managers and full-time controllers.

Accordingly, based on the management organizational structure, the Board of members or the Chairman of the construction company shall issue a salary schedule and salary rankings for managers and full-time controllers as a basis for implementing the insurance socialhealth insuranceunemployment insurance and other regimes according to the provisions of labor law.

The salary levels in the salary table are decided by the Board of Members or the Company President, but must ensure that the salary fund calculated according to the salary levels in the salary table must not exceed the planned salary fund of the manager. full-time staff according to the provisions of this Decree.

When constructing or amending and supplementing the salary schedule of managers and controllers, the Board of members or the President of the company must consult with the representative organization. Representatives of workers at the facility organize dialogues at the workplace according to regulations, report to the owner’s representative agency for approval and publicize at the company before implementation.

In the appendix to the Decree 21/2024/ND-CP amending the company class used to determine the basic salary of managers and full-time controllers specified in Appendix 1 of Decree No. 52/2016/ND-CP.

After the amendment, enterprises with 100% charter capital held by the State are divided into 6 classes with specific conditions for ranking.
