Tet bonuses of civil servants and public employees before and after salary reform

Salaries and benefits related to public employees’ salaries are specified in Article 12 of the Law on Public Employees No. 58/2010/QH12, 2010.

Officers are entitled to overtime pay hours, night work pay, per diem and other benefits according to the provisions of law and regulations of public service units; enjoy bonuses and be considered for salary increases according to the provisions of law and regulations of public service units.

According to the provisions of the Labor Code No. 45/2019/ QH14, Tet bonus as well as other types of bonuses are not considered a mandatory obligation of the employer.

Article 103 of this Code only stipulates that a bonus is an amount of money paid by the employer. Employers reward employees based on annual production and business results and the employee’s level of job completion.

Therefore, according to the above regulations, bonuses are Tet for civil servants and public employees will be decided by State agencies and public service units based on the assessment of each subject’s capacity and working efficiency. At that time, the specific Tet bonus level will also be decided by these units and agencies.

In addition, from July 1, 2024, comprehensive salary reform will be implemented for all subjects. cadres, civil servants, public employees and workers in State agencies and public service units.

At that time, the income structure of cadres, civil servants and public employees will additional bonus accounting for 10% of this subject’s total salary budget. And maybe, this bonus will include Tet bonus.
